DifferSense

Terms of Service and Privacy Policy

Effective: June 5, 2026; Last Updated: October 10, 2026

Terms of Service

Read these Terms before using this site or making a purchase. You agree to these Terms when you check the agreement box at signup or checkout, create an account, complete a purchase, or redeem a gift.

These Terms and our Privacy Policy spell out how we work together. Private and group coaching engagements are also covered by a separate Coaching Agreement, which you can review on the coaching offer page and agree to when you enroll. For anything specific to a coaching engagement, that agreement takes priority over these Terms; these Terms cover everything else.

What this covers

These Terms apply to your use of differsense.me and differsense.mykajabi.com, and to any product or service you get through the site, whether paid or free, including the materials that come with it.

Who can use this site

You must be at least 18 years old to purchase anything or use this site. By using the site, you confirm you meet that requirement.

Payments

All prices are in US dollars. Payments on this site are processed through Kajabi payments or other third-party processors (such as Stripe or PayPal). By completing a purchase, you authorize the charge to your payment method. DifferSense does not store full payment card details. You may choose to store your payment details in your Kajabi account subject to Kajabi’s terms of service and privacy policy.

Prices are subject to change. Changes will not affect completed purchases.

Prices include applicable sales tax. You are responsible for any other taxes in your jurisdiction.

Refunds
Digital products and self-paced courses

All sales of downloadable content and content for self-paced courses are final once the files have been accessed or downloaded. No refunds are issued. Where consumer protection law in your jurisdiction grants a refund or withdrawal right that cannot be waived, that right still applies.

Group and private coaching

Refund and cancellation terms for group and private coaching engagements are covered by the applicable Coaching Agreement.

Email subscriptions and free resources

You can unsubscribe at any time. No payment is collected for free content so no refunds apply.

Chargebacks

If something is wrong with your purchase, contact us first. Most things are quick to sort out, and we’d always rather hear from you than from your bank. Because digital products and course content are delivered right away and can’t be returned, disputing a charge with your bank instead of contacting us ends your access to that content and your license to use it. If you dispute a charge for content we’ve already made available to you, you agree to cover the amount you were charged, plus any fee our payment processor charges us for the dispute.

Intellectual property

All content on this site, including text, images, frameworks, tools, worksheets, course materials, and proprietary terminology (e.g., Friction Fluency™, SHIFT Sheetz™, Get Ur SHIFT 2gether™) is owned by DifferSense LLC and protected by applicable copyright, trademark, and intellectual property law.

When you buy a product or service, you get a personal right to use it, or, if you buy it as a gift, the person you give it to does. Either way, that right is for one person and cannot be passed on to anyone else.

What you agree not to do

When you use the site or buy from us, you’re agreeing to a few ground rules. We reserve the right to remove content or suspend access if they aren’t followed. You agree not to:

  • Copy, share, sell, adapt, or make your own version of DifferSense content, unless you credit DifferSense and have our written permission.
  • Use DifferSense content commercially without a written license.
  • Feed DifferSense materials into any AI system, language model, or automated tool, since these tools can use the materials in ways neither of us intended or can control.
  • Use the site in ways that break the law or violate someone else’s rights.
  • Harass, bully, threaten, demean, or disparage anyone, including DifferSense and its people. Disagreement and even salty language are fine. Personal attacks, insults aimed at someone, and harassment are not.
Scope of practice

The content, tools, coaching and consulting offered by DifferSense are for educational and developmental purposes. Nothing here is legal, financial, psychological, or medical advice. Outcomes depend on your circumstances, your effort, and the work you put in. The choices you make with what you learn are your own. We cannot guarantee specific results and do not claim to.

Site availability

We offer the site and its content for your use. We don’t promise the site will always be available or free of technical problems. Our offerings and the platforms we rely on may change over time, so we cannot guarantee access to online content indefinitely. Any materials we make available for download are yours to download and keep. We recommend saving your own copy so you’ll always have it, even if online access changes later.

Limitation of liability

If something goes wrong, the kinds of losses DifferSense is responsible for are limited, and the total is capped at what you paid. The next two sentences state these limits in precise legal terms.

To the fullest extent permitted by applicable law, DifferSense LLC and its owners, employees, agents, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages that come from your use of the site or any offering.

To the fullest extent permitted by applicable law, our total liability for any claim under these Terms will not exceed the amount paid for the specific product or service the claim is about.

Your responsibility for misuse

If someone takes legal action against DifferSense because you broke one of the rules in the "What you agree not to do" section of these Terms, you agree to cover what it costs us to handle it.

Third-party links and services

The site uses third-party services for functions like payment processing, scheduling, and email delivery. We limit these to platforms that meet a reasonable standard of data security. Those providers have their own terms of service, which also apply to you, and we encourage you to review them.

Changes to these Terms

We may update these Terms. When we do, we update the date at the top of this page. Changes apply going forward, not to purchases already completed. If we change the price, what's included, or the key terms of something you're already paying for, we will tell you. Because you check the box agreeing to these Terms each time you buy, the version of these Terms that governs is the one you accepted at the point of purchase.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Colorado.

If you have a concern or a dispute, contact us first so we can try to resolve it directly. Most things can be worked out this way.

If that doesn't resolve it, we'd encourage mediation or arbitration, conducted remotely, as a faster and less adversarial path than court. Because these processes only work when everyone takes part willingly, they are available by mutual agreement and are not required.

If a dispute still isn't resolved, either party keeps the right to pursue it in court. Any court action will be brought in Colorado. Nothing here limits your rights under applicable consumer protection law.

If part of these Terms doesn’t hold

If any part of these Terms cannot be enforced, the rest stays in effect.

Cookies

This site is built on the Kajabi platform. When you visit, Kajabi automatically sets cookies to support site functionality like keeping you logged in, managing course access, and processing transactions. These are essential to how the site works and do not require consent.

Kajabi also sets non-essential analytics cookies. If you are located in the EEA, UK, Canada, or Brazil, you will be asked for consent before non-essential cookies are placed, through the cookie consent tool on this site. You can update your preferences at any time through that tool or through your browser settings.

For a full list of cookies Kajabi uses, see Kajabi's Cookie Notice at kajabi.com/policies/cookie-notice. Blocking non-essential cookies may affect some site functionality.

Email

If you subscribe to our list, you will receive what you opted in for and may receive periodic updates and information about offerings. You can unsubscribe at any time. Unsubscribing from marketing emails does not affect messages about purchases you’ve made, like receipts and confirmations.

How long we keep it

We retain your information as long as needed to deliver services, meet legal requirements, and resolve disputes. When it is no longer needed, we delete or anonymize it. You may request deletion at any time (see Your Rights below).

Security

We take reasonable steps to protect your information from unauthorized access or loss. No method of transmission over the internet is fully secure, and we cannot guarantee absolute security. If a breach affects your rights, we will notify you as required by law.

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Ask us to delete your information, unless the law requires us to keep it
  • Get a copy of your data you can take elsewhere

  • Withdraw consent for marketing at any time

To use any of these rights, contact us through the form below. We will respond within the time the law requires. We may need to verify your identity first.

If you are in the EEA or UK and believe we have not handled your data appropriately, you may file a complaint with your local data protection authority.

California residents: We do not sell personal information or share it to target ads. Contact us with any requests or questions.
